This document is an electronic record under the provisions of the Information Technology Act, 2000 and the Information Technology (Intermediaries Guidelines and Digital Media Ethics Code) Rules, 2021, as applicable and amended from time to time. This document is generated by a computer system and does not require any physical or digital signatures.

This Terms & Conditions and Service Agreement ("Agreement") governs the use of the website www.rishtaywala.com and the services provided by Rishtaywala.com Matrimonial, including mobile applications, communication systems, and any other online/offline platforms operated under the brand "Rishtaywala.com". By accessing, browsing, registering, or otherwise using the website and services, you agree to comply with and be bound by these Terms & Conditions, including the policies referenced herein and as updated periodically.

If you do not agree with these Terms & Conditions, you should not use the website or the services offered by Rishtaywala.com Matrimonial.

1. Definitions

• Rishtaywala.com Matrimonial (RW): Refers to Rishtaywala Matrimonial, owned and operated by JMD CONNECT (INDIA) PRIVATE LIMITED which provides matrimonial services.
• Website/App: Refers to www.rishtaywala.com and the official Rishtaywala.com Matrimonial mobile applications.
• Member/User: Any individual who accesses the website, registers for services or uses the platform to search for prospective matches.
• Registrant: A person (such as parent, sibling, relative or friend) creating a profile on behalf of a prospective bride or groom with their consent.
• Services: Collectively refers to free and paid membership features, matchmaking tools, profile creation and any related offline/online services offered by Rishtaywala.com Matrimonial.
• Content: Includes text, images, documents, videos and any data provided by users or generated on the website.

2. Scope of Services

• Registration of profiles by prospective brides, grooms or their authorized representatives.
• Browsing, short listing and expressing interest in other registered profiles based on mutual preferences.
• Providing free and premium subscription plans that enable communication, contact details access and matchmaking features.
• Offering optional Assisted Matrimonial Services through Relationship Managers for premium members.

Rishtaywala.com Matrimonial does not guarantee marriage, alliance success or compatibility results. The responsibility of verifying the credentials and suitability of any match rests solely with the members.

3. Eligibility Criteria

A. Nationality and Background

• Must be an Indian Citizen, Non-Resident Indian (NRI), Person of Indian Origin (PIO), or Person of Indian Heritage intending to marry someone of Indian origin.
• Individuals from other nationalities intending to marry an Indian or person of Indian origin are eligible, subject to compliance with their local marriage laws.

B. Age Requirements

• Minimum 18 years for women.
• Minimum 21 years for men.

C. Marital Status

• Single, divorced, widowed, or awaiting divorce (with legal documentation) is eligible to register.
• Registrants creating profiles for others must obtain explicit consent from the individual concerned.

D. Legal Competency

• Must be legally competent to marry under applicable Indian laws or respective country laws.
• Users registering with false or misleading information will have their accounts terminated without refund.

4. Registration and Member Account

A. Profile Creation

1. Members must complete the registration process honestly and accurately, providing:
   • Full name
   • Date of birth
   • Gender
   • Marital status
   • Contact information (verified mobile number and email ID)
   • Recent photographs (preferably less than 3 months old)
   • Optional details such as occupation, education, income and family background
2. Rishtaywala.com Matrimonial may use your profile details to display in related matrimonial domains for better matchmaking.

B. Duplicate Accounts and False Information

• Duplicate profiles for the same individual are strictly prohibited.
• Any false, misleading or incomplete information may result in account suspension or termination without refund.

C. Account Security

• Members are responsible for safeguarding login credentials such as username, password, and OTP.
• Rishtaywala.com Matrimonial never asks for your password.
• Members must log out after every session on shared devices to prevent unauthorized access.

D. Assisted Registration

• Members may receive registration assistance via phone support or offline campaigns.
• Consent will be obtained before creating any profile on behalf of someone else.

5. Roles and Responsibilities of Rishtaywala.com Matrimonial

1. Providing a matchmaking platform where members can create profiles, search, and connect with other users.
2. Reproducing and displaying profile information as entered by members without independent verification.
3. Offering premium features including contact viewing, messaging, and assisted services.
4. Implementing security standards to safeguard sensitive user data.
5. Providing customer support and grievance redressal as per IT Guidelines.

Rishtaywala.com Matrimonial is not responsible for:

• Authenticity of user-provided information
• Background verification of members
• Financial or personal transactions between members
• Guaranteeing marriage, engagement or alliance outcomes

6. Roles and Responsibilities of Members

1. Provide accurate information during registration and profile updates.
2. Verify the credentials of other members independently before making decisions.
3. Maintain appropriate conduct while interacting with other members.
4. Avoid the following actions:
   • Sharing false, misleading or offensive content
   • Engaging in abusive, discriminatory or unlawful communication
   • Entering into financial transactions with other members
   • Requesting or offering money, gifts or favors
   • Sharing sensitive information like bank details, OTP or passwords
5. Respect privacy and do not misuse other members’ personal data.
6. Delete profile after marriage or inform Rishtaywala.com Matrimonial to deactivate the account.
7. Use secure devices and networks to access the platform.
8. Refrain from using bots, scripts, or any automated tools to access or interact with the website/app.
9. Role and Conduct:
   • As a condition of using Rishtaywala’s services, you agree to our User Code of Conduct, which includes zero tolerance for abusive, harassing, defamatory, pornographic, hateful or otherwise objectionable content, whether in profile text, images, messages, or any other user-generated content.
   • Users must not post, send or share any content or communication that is unlawful, harmful, offensive, discriminatory, or in violation of these Terms. Violations will lead to immediate suspension or termination of the account, at our discretion.
10. Reporting & Moderation
    • Users may report or flag any content, user profile, message, image, or behavior they believe to be abusive, inappropriate or in violation of these Terms via the “Report” function available in the app or website.
    • All reports will be reviewed by our moderation team. We use a combination of automatic detection tools and human moderators to assess reports. Based on severity, violations may result in removal of content, account suspension, or permanent termination.

Violation of these responsibilities may result in suspension or termination of membership.

7. Communication Policy

1. Members consent to receive communications from Rishtaywala.com Matrimonial via:
   • Email
   • SMS
   • Phone calls
   • WhatsApp messages
2. Members can customize communication preferences or opt out of promotional messages.
3. Rishtaywala may share profile suggestions, alerts and updates automatically.

8. Privacy & Confidentiality

1. Member data is treated confidentially and in accordance with our Privacy Policy.
2. Rishtaywala.com Matrimonial implements security measures, encryption and access controls to protect user data.
3. Members agree that certain non-sensitive information like first name, age, religion, occupation and profile photo will be visible to other users.
4. Rishtaywala.com Matrimonial may share limited data with law enforcement if required by law.

9. Grievance Redressal

10. Disputes Between Members

1. Members are solely responsible for any interactions or communications with other members.
2. Rishtaywala.com Matrimonial is not a party to any disputes, negotiations, or financial transactions between members.
3. Any class-action or group complaints are expressly waived.

11. Content Ownership and Usage Rights

1. All content uploaded by members remains their property, but they grant Rishtaywala.com Matrimonial a non-exclusive, royalty-free license to display and distribute their profile for matchmaking.
2. Members are responsible for ensuring no copyright or trademark violations.
3. Any abusive, obscene, defamatory or illegal content may result in immediate profile deletion.

12. Membership Plans & Fair Usage Policy (FUP)

• Free Membership: Profile creation, limited browsing
• Gold, Diamond, Platinum Plans: Extended contact views, personalized messages
• Prime & Assisted Plans: Premium services including Relationship Manager support

Fair Usage Limits:

• Phone Views: 20/day | 100/week | 750 total
• Personal Messages: 50/day | 150/week | 4,000 total

13. Payment, Refund, and Renewal Policy

1. Payments can be made via UPI, Net Banking, Debit/Credit Card, Wallets or Cheque/NEFT.
2. Membership fees are non-refundable, except under official money-back guarantees (if applicable).
3. Memberships auto-renew unless canceled via email to team@rishtaywala.com.
4. Maximum membership duration is 12 months per plan.

14. Limitation of Liability & Disclaimers

1. Accuracy or authenticity of member profiles.
2. Marriage or alliance outcomes.
3. Financial or emotional loss from member interactions.
4. Any technical or service interruption, including force majeure events.

Use of Rishtaywala.com Matrimonial services is entirely at your own risk.

15. Termination & Suspension

• Suspend or delete profiles violating terms.
• Terminate memberships for fraudulent or abusive activity.
• Forfeit fees in case of termination due to member misconduct.

16. Governing Law & Jurisdiction

1. This Agreement is governed by the laws of India.
2. Any disputes will fall under the exclusive jurisdiction of courts in New Delhi, India.
3. Arbitration for NRI members will be conducted as per the Arbitration and Conciliation Act, 1996.

17. Indemnity

Members agree to indemnify and hold harmless Rishtaywala.com Matrimonial its employees and partners from any loss, liability, or claim arising from:

• Misuse of the platform
• Violation of these Terms & Conditions
• Any third-party claims due to member actions

18. Disclaimer of Marriage Guarantee

Rishtaywala is a matchmaking platform only. Registration does not guarantee marriage or alliance. Success depends solely on mutual decisions between members.

19. Ownership & Corporate Information

1. Ownership: Rishtaywala.com Matrimonial and its services are solely owned and operated by JMD CONNECT (INDIA) PRIVATE LIMITED, a company incorporated under the Companies Act, 2013, with its registered office at: D-210, 2nd Floor, Rohini Sector 29, Rohini Heights, New Delhi – 110042, India.
2. Brand Usage: The brand name "Rishtaywala.com Matrimonial" is exclusively operated under the rights of JMD CONNECT (INDIA) PRIVATE LIMITED
3. Powered By: All technology, platform infrastructure, and customer support services for Rishtaywala are powered by JMD CONNECT (INDIA) PRIVATE LIMITED

20. Additional Terms for Corporate Transparency

1. Contact Information: For corporate inquiries, partnerships or official notices, you may write to: team@jmdconnectindia.com
2. Authorized Entity: All contracts, invoices, receipts and payments are processed through JMD CONNECT (INDIA) PRIVATE LIMITED
3. Intellectual Property: The design, platform, brand, logo and proprietary systems of Rishtaywala.com Matrimonial are the intellectual property of JMD CONNECT (INDIA) PRIVATE LIMITED and cannot be copied, reproduced, or distributed without prior written consent.
